As provided by his chambers, here is the text of the news release issued by District Judge H. Patrick Weir:
I wish to announce that I will not be on the ballot for election in November for S.W. District Judge.
I am making the announcement at this time so that any lawyer who may wish to run will have ample time to obtain the necessary signatures to get on the ballot.
I have enjoyed my service on the bench. However, since I would not plan on serving the full six-year term after January, 2013, should I run and be elected, I am hopeful that this announcement will give the voters the opportunity to select their next judge for a full term on the bench.
Under Section 27-05-02.1, N.D.C.C., the Supreme Court is required to review the impending vacancy and determine, within 90 days of receiving notice, whether the office is necessary for effective judicial administration. The Supreme Court may, consistent with that determination, order the position filled or order the office transferred to a judicial district in which an additional judge is necessary, to be filled in that district.
